About Us

Shanghai Imilab Technology Co., Ltd. (hereinafter referred to as “Imilab” or “we”) and its affiliates take your privacy very seriously. We have taken your demand into consideration while preparing the Policy. You will know our collection and use conventions of personal information comprehensively and have final control over the personal information you have provided to us.

About the Policy

The Policy specifies how Imilab collects, uses, transmits, publicizes, handles, storages, protects and deletes the information you provide for us while using Imilab Home app products and services. Where you are required to provide some information to verify your identity before using intelligent camera products and/or services, we will use the information in strict accordance with the Policy and/or our user terms and conditions.

Unless otherwise specified under the laws applicable in your place, “personal information” in the Policy refers to various information related to the identified or identifiable natural persons, which is recorded in electronic or other forms, excluding anonymized information. If required, according to the applicable legal classification, personal information also includes sensitive person data or information. We will use such information in strict accordance with the Policy.

For compliance with applicable laws, including the local data protection laws (such as Data Security Law of the People's Republic of China and General Data Protection Regulation), we will not process any of your personal data without your explicit consent unless otherwise specified by the applicable laws. In addition, we hereby commit to protect the privacy, confidentiality and security of your personal information in accordance with applicable laws (including data protection laws and regulations of your place). We also make sure that all our staffs and agents will perform these obligations.

Finally, we wish to bring the best experience for our users. Your question is always appreciated.

I. Information We Collect and How it is Collected

(I) Circumstance where you should authorize us to collect and use your personal information

We collect your personal information on the principle of legitimacy, legality and necessity for the purpose of providing products and/or services and ensuring that we obey the relevant applicable laws, regulations and other normative documents. You are entitled to provide such information at your own discretion, but in most cases, if you refuse to provide such information, we may be unable to provide our services or answer your questions. These functions include:

(1) Smart device connection

For the convenience of providing you with Imilab Home app services and enable you to securely connect and manage smart devices, we may collect information related to your Wi-Fi , location, login account, mobile phone and smart device as well as the correlation between Imilab Account and smart devices. Such information will be used to provide such functions as fast smart device connection, connection, discovery of surrounding device and device management. The information above is detailed as follows:

● Login account information: Imilab Account number, name and profile.

● Mobile phone information: hardware device identifier (OAID, Mac address and Android ID), phone model, system version information, system language, country or region in which the phone is set, version number of the app store, phone screen size and resolution, CPU and display device information.

● Device related information: information about the hardware, performance, status, etc. of your device, including device name, device ID (DID), firmware version, installation location (such as in the living room), time zone, security code (if any) for viewing the device, electric quantity of the device, as well as memory card information (errors, remaining storage, recording mode).

● Information about device settings: we may collect information about device settings, including without limitation dormancy settings, image settings, night vision settings, Home Surveillance Assistant settings (sensitivity, home surveillance period, shooting interval, push settings), floating window play and cloud platform calibration.

● Information collected during smart device connection: based on the type of smart device you want to connect, the following information may be collected:

Smart devices connected over Wi-Fi: Wi-Fi information (SSID, BSSID, Wi-Fi Mac address and Wi-Fi password), Mac address of the device, device ID, device model, device ID (DID), device name, device status, Wi-Fi connection mode (LAN mode or remote mode), IP address assigned to the device, Wi-Fi signal strength, received Wi-Fi signal strength indicator (RSSI).

● Smart devices connected over Wi-Fi after establishing a local connection over Bluetooth: Wi-Fi information (SSID, BSSID, Wi-Fi Mac address and Wi-Fi password), Mac address of the device, device ID, device model, device ID (DID), device name, device status, Bluetooth signal strength, Wi-Fi connection mode (LAN mode or remote mode), IP address assigned to the device, Wi-Fi signal strength, received Wi-Fi signal strength indicator (RSSI).

● Smart devices connected over Bluetooth: device name, device status, Bluetooth signal strength, IP address assigned to the device, Bluetooth Mac address.

(2) Device sharing

We support you to share your smart devices with others through Imilab Account. After sharing, the shared users can also control the smart devices. For this function, we may collect your account ID, share account ID and information about the shared device (device ID, device name, authentication key of the device, share status of the device), so that we can provide you with the function of sharing your device with others for common control and use and displaying the share status on the device list page.

(3) Application and smart hardware upgrade:

In order to enable you to use the latest Imilab Home app services on a continuous basis, we may use the version information of Imilab Home app and phone model to upgrade Imilab Home app for you. Meanwhile, we may collect the list and version number of smart devices you have connected, to upgrade the smart devices for you, so that you can use the latest version of services (including the firmware version).

(4) Pairing with device and synchronize data

We will collect information about accounts, device and network to synchronize data, enable the device to accept plug-in instruction, and upload data to server (applicable to specific functions/services only).

(5) Viewing live image

You can view the live image at any time through the mobile client. For this reason, we will collect information about current image time, playback speed, image quality option and volume. In addition, you can snap a screen-shot/record the current live image. Live image screen-shot/video recording will be saved on your phone instead of being uploaded to any server. You can also control the angle with the arrow keys. To do this, we will send your control instructions to the device.

(6) Home Surveillance Assistant

You can enable or disable the Home Surveillance Assistant function. If enabled, video recording will be triggered when image changes or there are moving persons within the detection range of the camera. You can set the distance (in meters) away from the door to trigger video recording, the start and end time of home surveillance, and the shooting interval to avoid interruption from one same event. You can view the videos on-line on your phone. To do this, we will collect information about your settings on sensitivity, home surveillance periods, shooting interval, and image change push notification on/off, as well as your recording information (recorded voice, recording time and recording duration). If you use the memory card, you can also store the video in the memory card in the recording mode you set.

(7) Video playback

You can view videos of various types in the plug-in. To do this, we will collect the triggering events and the videos triggered by Home Surveillance Assistant, and save them in a secure server after encryption. You can download, view and delete them at any time within the time specified and extend the storage time or view videos from earlier dates by upgrading the member type. To do this, we will collect network information and member information.

(8) Management of memory card

You can store the video on a memory card for view at any time. If the storage space of the memory card is insufficient, new videos will be overwritten automatically, and you can manage the video in the plug-in as required. To do this, we may collect memory card information (abnormal state, remaining capacity and recording mode).

(9) Two-way talk-back

You can view information about the live image in the plug-in and chat with two-way talk-back function. We will not collect information about your conversation, unless you select to record current live image (and save it locally on the phone) before/during use of the two-way talk-back function. Under no circumstances will we try to read or identify your conversation.

(10) Send notifications

The device will send notifications according to triggering events. For example, you can send notifications to the mobile phone when the screen changes. To do this, we will collect information about your push settings. You can turn off the push function in Settings - House Surveillance Assistant - Push Type.

(11) Device information

We will receive and record information about the mobile devices you use (including the model, operating system version, settings, environment, MAC address, IMEI, IDFA, identifier, other software & hardware characteristics and location of your mobile phone (including information about GPS location, WLAN access point, Bluetooth, base station and other sensors authorized by you)) and the smart devices you use or share (such as information about the smart devices whose network configuration has been completed through us, including device model, operating system version, device settings, device environment, type of operational functions (such as switch on/off, etc.), MAC address, IMEI, IDFA, device identifier and other software & hardware characteristics) depending on the specific permissions you grant in software installation and use.

(12) Log information

When you use the services provided by us or the client, detailed information about your use of our services will be automatically collected and saved as relevant network logs. Such information includes without limitation your account information, device information, APP version, IP address, telecommunication operator, language used, location, access date and time and error logs when failures occur.

(II) You may choose whether to authorize us to collect and use your personal information

In order that you can better enjoy the services provided by Imilab Home app, such as control and management of smart devices, your personal information may be collected and used by the additional functions below. You can still use the basic services of Imilab Home app even if you do not provide the personal information, but you may be unable to use the additional functions below, which can bring convenience to you. The additional functions include:

(1) User feedback

We may collect the questions and feedback logs you send us as well as the email address you fill in. Such information will be used for us to better understand the problems you encounter and to contact you.

(2) Third-party account information

We may obtain your third-party account information (such as ID, portrait, nickname and other information shown on the page) from a third party upon your authorization, and bind it to your Imilab Home account, so that you can directly login and use our products and/or services through the third-party account. We will use your information to the extent authorized by you.

(III) You are fully aware that we can collect and use your personal information under the following circumstances:

1. Where the information is related to national security and national defense security;

2. Where the information is related to public security, public health and major public interests;

3. Where the information is related to criminal investigation, prosecution, trial and execution of judgment;

4. Where we need to collect and use your personal information for the purpose of safeguarding the life, property and other major lawful rights & interests of the subject of personal information or other individuals, but it is difficult to obtain the consent of the subject;

5. Where the personal information collected is disclosed by the subject to the public;

6. When your personal information is collected from legally disclosed information, such as legitimate news reporting, government information disclosure and other channels;

7. Where it is necessary for signing the contract as you required;

8. Where it is necessary for maintaining the safe and stable operation of the products and/or services provided, such as finding and handling product and/or service faults;

9. Where it is necessary for legitimate news reporting;

10. Where it is necessary for academic research institutions to carry out statistical or academic researches, and the personal information contained in the results will be de-identified when the results of academic research or description are provided to the public;

(IV) Non-personal information

We may also collect other information of which the specific subject cannot be identified (i.e., the information other than personal information), for example, the statistical data generated when you use a specific service, such as the user operations (including clicking, page jumps and browsing time). Such information is collected for the purpose of improving the services we provide to you. The type and quantity of the information collected depend on how you use our products and/or services. We will summarize such information to help us provide customers with more useful information and understand in which parts of our website, products and services are most attractive to our customers. For the purposes of the Policy, summarized data is treated as non-personal information. If we use non-personal information in combination with personal information, such non-personal information will be treated as personal information during such combination.

II. How Do We Use Cookies and Similar Technologies

● Imilab Home app and third-party service providers use such technologies as Cookie, tags and scripts for trend analysis, website management, tracking of users' web activities and collection of statistical information about the entire user base. We will receive individual or aggregate analysis reports collected with the technologies above. Such technologies can help us better understand your behavior, enable us to know which parts of our site our users are viewing, measure the effectiveness of advertising and web search, and improve upon it. We treat the information collected through Cookies and other technologies as non-personal information. However, we will treat Internet Protocol (IP) address or similar identifiers as personal information if the same are considered as personal information under the local law.

● Log files: like most websites, we will collect specific information and store it in log files. Such information may include Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), reference/exit page, operating system, date/time stamp and/or click-stream data. We will not associate automatically collected log data with other information we collect.

● Mobile analysis: in some mobile applications, we use mobile analysis software to better understand the functionality of our mobile software in your phone. The software may record such information as how often you use the application, events that occur within the application, cumulative use, and performance data and where the application crash occurs. We will not associate the information stored in the analysis software with any personal information you submit in the mobile application.

● Local storage - HTML5/Flash: We use locally stored objects (LSO), such as HTML5 or Flash, to store contents and preferences. Depending on your web browsing behavior, third parties that we work with to provide certain functions or advertise on the website may also collect and store relevant information through HTML5 or Flash Cookie. III. Who Do We Share Your Information With?

We will never transfer any personal information to any third party. However, if you expressly agree with the transfer or Imilab conducts business reorganization, merger, division, acquisition, bankruptcy, etc., where personal information transfer is involved, we will require the new company or organization holding your personal information to continue to be bound by the Policy, otherwise, we will require the new subject to obtain your consent again.

Occasionally, we may disclose your personal information to a third party (as described below), in order to provide the products and/or services you require.

We may disclose your personal information to third party service providers and affiliates as listed below in this section. In all circumstances mentioned in this part, you can rest assured that Imilab will only share your personal information according to your authorization. Your authorization to Imilab will cover various sub-processors that process your personal information. You should understand, in any case described below, when sharing your personal information with a third party service provider, Imilab will specify the third party's practices and obligations in the form of contract and comply with applicable local data protection laws. Imilab will make sure through contract that all third party service providers will comply with the privacy right standards applicable to themselves within your judicial district.

(I) Information shared with our group and third-party service providers

To facilitate business and provide you with all functions of products and services, we may disclose your personal information to affiliates or third party service providers of Imilab (for example, our mail store, delivery service supplier, Telecom, data center, data storage facility, customer service provider, advertising and marketing service supplier, and Imilab’s agent) [affiliates and/or other third parties] (collectively, "third party service providers"). Such third party service providers may process your personal information on behalf of Imilab or for one or more of the above purposes. If you no longer allow us to share such information, please contact us by email to cm-privacy@imilab.com.

(II) Information shared with others

If requested by applicable laws, Imilab may disclose your personal information without further consent.

(III) Information shared with no consent

We may share anonymous information with a third party (e.g. advertising agency on our website) in the form of summary for business purpose. We may share general usage trend of our services with the third party, such as quantity of customers among the specific population purchasing certain product or conducting certain transaction.

For the avoidance of doubt, Imilab may collect, use or disclose your personal information without your consent to the extent and under the circumstances explicitly permitted by local data protection laws (for example, for complying with the subpoena). Such disclosure may be made in good faith if it is necessary to safeguard our rights, ensure the safety of you and others, investigate fraud or make response at the request of local government.

IV Safety Guarantee

(I) Our safety measures

We commit to ensure the security of your personal information. To prevent unauthorized access, disclosure or other similar risks, we have implemented reasonable physical, electronic and management measures to protect the information we collect while you are using Imilab Home app. We will adopt all reasonable measures to protect your personal information.

For example, when accessing Imilab Account, you can ensure the security better through the two-step verification procedure. After you send or receive information to or from our server through Imilab device, we commit to make encryption through security socket layer (SSL) and other algorithm.

All your personal information is saved in a safe server and protected by controlled facilities. We classify your data based on importance and sensitivity and make sure your personal information is at the highest safety level. We commit that the employees and third party service providers providing products and services for you by accessing such information have strictly performed the contractual duty of confidentiality and will be subjected to disciplinary punishment or termination of cooperation once they fail to abide by the obligations in good faith. Similarly, we have established special access control for cloud-based data storage. All in all, we will review information collection, storage and processing practice at regular intervals (including physical safety measures), to avoid any unauthorized access and use.

We will take any feasible measures to protect your personal information. However, you should be aware that the use of Internet is not always safe. Therefore, we cannot ensure the security or integrity of any personal information during two-way transmission of Internet.

We will take appropriate measures against personal data leakage, such as notifying the relevant regulatory authorities of the leakage phenomenon, or in some cases notifying the data subject of personal data leakage according to applicable laws (including your local data protection laws).

(II) Your deeds

Do not disclose your login password or account information to anyone (except for the person obtaining your formal authorization) to ensure the security of your personal information. Whenever you log in as a user of Imilab Account and particularly via others’ computer or public Internet terminal to use Imilab Home app and services, you shall log out after use.

Imilab assumes no responsibility for any safety omission ascribed to a third party accessing your personal information resulted from your failure to keep privacy of personal information. Notwithstanding the above provisions, you shall notify us immediately in case that any other user of Internet uses your account without authorization or there is any other security hole.

Your assistance facilitates our privacy protection for your personal information.

V. Our Reservations

We will retain personal information within the period necessary for the purposes for which it is collected or required or permitted by applicable law. After the personal information is collected, or we confirm your application for deletion or cancellation, or we stop operating the corresponding products or services, we will no longer retain personal information and will eliminate or anonymize the personal information. Imilab may further retain data for further processing and filing of information for public interests, for scientific or historical research purposes or for statistical purposes in accordance with applicable law, even if the purpose of further information processing is inconsistent with the original purpose.

VI. Accessing Other Functions of Your Device

Our application program may access some functions of your device, such As Wi-Fi network status. With such information, our application program could be run on your device and interact with you. You can close these functions through device settings or cancel these functions by email to cm-privacy@imilab.com. at any time.

VII. Your Rights

(I) Control setup

Imilab acknowledges different people may concern privacy from different points. Therefore, we provide some cases to explain the various methods provided by Imilab for your choice, so as to restrict the collection, use, disclosure or processing of your personal information and control your privacy setup:

● Log in or log out of Imilab Account:

● Click "Me - Personal Information" in the Imilab Home app to modify your personal information, including without limitation nickname, phone number and avatar;

● Turn motion detection on or off.

If you have agreed us to use your personal information for the above purpose, you may also change your decision by email to cm-privacy@imilab.com.

(II) Accessing, updating, correcting or erasing your personal information

You have the rights to access and/or correct any personal information related to you we hold. Where you update your personal information, your identity shall be verified before processing your request. Once we obtain sufficient information and can deal with your request for accessing or correcting your personal information, we will respond to your request within the time as specified by data protection laws.

Upon your request, we may provide you with a free copy of your personal data collected and processed. For any additional request for the same information, we may charge a reasonable fee as per the actual administrative expenses in accordance with applicable laws.

If you wish to access your personal information held by us, or if you believe that any information held by us is incorrect or incomplete, you can contact us by email to cm-privacy@imilab.com.

Under the following circumstances, you have the right to request Imilab to delete your personal information:

We have collected your personal information without your express consent;

Our handling of your personal information is in violation of laws and regulations;

We use and process your personal information in violation of our agreement with you;

You have canceled your Imilab Account, uninstall or stop using our products or services;

We have ceased the services to you.

You can request us to delete your personal information by email to cm-privacy@imilab.com. We will respond within 10 days. When you or we help you delete the relevant information, we may not be able to delete the corresponding information from the backup system immediately due to limitation of the applicable laws and security technologies. We will store your personal information safely and isolate it from any further processing until the backup can be eliminated or anonymized. For example, according to the E-Commerce Law of the People’s Republic of China, the retention time of information about your products, services and transactions shall not be less than three years from the date when the transaction is completed.

We are entitled to refuse to deal with any meaningless/entangled repeated requests, requests that harm others’ privacy rights, extremely unrealistic requests, requests for disproportionate technical work, requests that would not be given according to local laws, information that has been made public, and information given under the confidential conditions. We may also refuse to delete the request for elimination of or access to the data if we think that some aspects of the request for elimination of or access to the data may make us unable to legally apply the data for the aforementioned anti-fraud and security purposes.

For more details about your personal information in Imilab Account, you can access and change the same by logging in the Account on your device.

If you are an EU user under the General Data Protection Regulations (GDPR), you have the right to ask us to remove your personal information. If there are relevant provisions in GDPR, we will consider the reasonableness of such elimination and take reasonable steps including technical measures.

If you are an EU user under the General Data Protection Regulations (GDPR) and you have the right to restrict our handling of your personal information, we will consider the reasonableness of such restriction. If there are relevant provisions in GDPR, we will only process your personal information in a manner consistent with the applicable provisions in GDPR and notify you before the restriction is lifted.

If you are an EU user under the General Data Protection Regulations (GDPR), you have the right not to be affected by a decision based solely on automated processing (including profiling) that may have a legal effect or similar material effect on you.

If you are an EU user under the General Data Protection Regulations (GDPR), you have the right to receive your personal information in a commonly used structured format and transmit such information to another data controller.

(III) Agreement cancellation

● You can cancel your agreement on our collection, use and/or disclosure of your personal information we master or control in the form of a request. Depending on the service you are using, you can cancel the agreement by sending an email to cm-privacy@imilab.com. We will process your request within a reasonable time upon your request, and will never collect, use and/or disclose your personal information according to your request thereafter.

● We hereby remind you that your agreement cancellation will lead to some legal consequences. According to the scope of your personal information we can no longer process based on your authorization, you may no longer enjoy Imilab Home app products and/or services. However, your decision to cancel the agreement or authorization will not affect the previous processing of your personal information based on your authorization.

(IV) Authorization cancellation

If you wish to close your Imilab account, you may complete the corresponding cancellation procedures through “Me - About- Legal Information - Authorization Cancellation” in the Client. You may also send email to cm-privacy@imilab.com to contact us, and execute corresponding processes as instructed in the e-mail. Please note issues we inform you in the e-mail. After we verify your identity and formally start the account cancellation procedures for you, we will immediately stop offering you products or services, delete, anonymize, or process your personal information by other means specified by the law (except as otherwise provided by laws and regulations or required by regulatory authorities. For example, as stipulated by the Cybersecurity Law of the People’s Republic of China, your network operation logs shall be stored for at least six months). Please note that, after authorization cancellation, you will not use Imilab’s products and services.

VIII. Transfer Your Personal Information Beyond Your Judicial District

Imilab processes and backups personal information through global operation and control facilities. Currently, Imilab has data centers in Singapore, PRC, European Union and U.S. For the purposes described in the Policy, your information may be transferred to these data centers in accordance with applicable laws.

Subject to compliance with applicable laws, we may also transmit your personal information to our third party service providers and business partners. Therefore, your information may also be transmitted to other countries or regions. Personal information may not be protected in the judicial district where the global facilities are located in accordance with the same standards applied in your judicial district, and may have different risks under different data protection laws. However, this will not change our commitment to abide by the Policy and protect your personal information.

In particular,

All personal information collected and generated from operations in Chinese mainland will be stored in the data centers in Chinese mainland, except where cross-border transmission is permitted under applicable laws.

All personal information collected and generated from operations in U.S. will be stored in the data centers in U.S., except where cross-border transmission is permitted under applicable laws.

All personal information collected and generated from operations in EU will be stored in the data centers in EU, except where cross-border transmission is permitted under applicable laws.

If we need to transfer the personal information beyond your judicial district, we will abide by applicable laws whether it is transferred to our affiliates or third party service providers. By implementation of the unified security measures, we ensure that all such transfer will meet the requirements of applicable local data protection laws. You will have the right to learn about the appropriate protection measures taken by Imilab when transmitting your personal information by e-mail to cm-privacy@imilab.com.

If Imilab transfers the information generated by you in European Economic Area (EEA) to a relevant institution or third party service provider of Imilab outside EEA, we will do so according to the security protection mechanism set out in the EU Standard Contractual Clauses or the General Data Protection Regulation (GDPR). You have the right to learn about our existing security protection mechanism or to request a copy of our standard contract by email to cm-privacy@imilab.com.

IX. Miscellaneous

(I) Juveniles

We believe it is the responsibility of parents or other guardians to supervise their children on use of our products and services. However, according to the Policy, it is forbidden to obtain juveniles’ personal information or send any promotional data to them.

Imilab will not seek or attempt to seek and receive any personal information from juveniles. If the parent or guardian has a reason to believe their children submit personal information to Imilab without their prior approval, please feel free to contact us to delete such personal information and make sure the children cancel the subscription of any applicable service of Imilab.

(II) Order of precedence

In case of any inconsistency between the user agreement you agree with and the Policy, the former shall prevail.

(III) California privacy rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties.

(IV) How do we manage your personal information in accordance with GDPR

If you are an EU user under GDPR, Imilab will provide a systematic approach to managing personal data by applying a risk management method, so that our personnel, management process and information system can be deeply involved. For example, according to GDPR, (1) Imilab has set up a Data Protection Officer (DPO) in charge of data protection, and DPO can be contacted through dpo@imilab.com; (2) Imilab will appoint a representative in Europe, whose contact information is representive@imilab.com; (3) Imilab will establish such procedures as data protection impact assessment (DPIA).

(V) Privacy policy updating

We will check the Policy at regular intervals, and may also update it to reflect the change of our information conventions. In case of any major change in the Policy, we will notify you by email (sent to the email address designated by your account) or release on Imilab’s APP or via mobile device, so that you could know our collected information and how we use the information. Such changes in the Policy will come into effect upon the effective date as specified in notice or website. You are suggested to check this web-page regularly to obtain the latest information about our privacy practice. You will be deemed to accept the updated privacy policy if you continue to use the products and services on website, mobile phone and/or any other devices. We will obtain your approval again if we intend to collect more personal information from you or use or disclose your personal information for any other purpose.

X. Third Party Websites and Services

The Policy does not apply to the products and services provided by any third party. The products and services of Imilab may include third party products and services as well as links to third party websites. When you use such products or services, we may also collect your information. Therefore, we strongly recommend that you take some time to read the third party's privacy policy, as you read the Policy. We are not responsible for or in any way control how third parties use the personal information they collect from you. The Policy does not apply to other websites linked through our services.
